A. General Terms and Conditions

1. Scope/strong>

1.1. These General Terms and Conditions for Feine Billetterie of Andrea Pfaff (hereinafter referred to as the “Seller”) apply for all contracts that a consumer or entrepreneur (hereinafter referred to as the “Customer”) concludes with the Seller concerning the goods and/or services presented by the Seller in its online shop. The inclusion of the Customer’s own terms is hereby rejected, unless otherwise agreed.

1.2. A consumer within the meaning of these General Terms and Conditions is any natural person who enters into a legal transaction for a purpose which cannot be attributed to their commercial or independent professional activity. An entrepreneur within the meaning of these General Terms and Conditions is any natural or legal person or an incorporated partnership that concludes a legal transaction in performance of its independent professional or commercial activity.

2. Conclusion of contract/strong>

2.1. The product descriptions presented in the Seller’s online shop are not binding offers on the part of the Seller, but serve to prompt the submission of a binding offer by the Customer.

2.2. The Customer can place the offer by telephone, in writing, by fax, by e-mail or using the online order form integrated into the Seller’s online shop. When placing an order using the online order form, the Customer enters into a legally binding contract in relation to the goods in the shopping cart in the final step of the ordering process after entering their personal data and clicking the “Submit order” button.

2.3. The Seller may accept the offer of the Customer within five days by means of written (letter) or electronically transmitted (fax or e-mail) confirmation of order or by delivering the goods. The Seller has the right to refuse acceptance of the order.

2.4. Contact usually takes place by e-mail and order processing is automated. The Customer must ensure that the e-mail address specified by it for order processing purposes is correct so that e-mails sent by the Seller to this address are received. In particular, the Customer shall ensure that, if spam filters are used, all e-mails sent by the Seller or third parties instructed by the Seller with the order processing can be delivered.

3. Return costs when exercising the right of withdrawal

If the Customer has a right of withdrawal and exercises it, the regular cost of return will be charged to it if the price of the goods to be returned does not exceed 40 euros or if, in the case of a higher price of the goods, the Customer has not yet made payment or partial payment at the time of the revocation, unless the goods delivered are not as ordered. In all other cases, the Seller bears the cost of return.

4. Prices and terms of payment

4.1. The prices quoted by the Seller are final prices and include the statutory German VAT. Additional delivery and shipping costs that might be incurred are displayed separately in the respective product description in the offer. 

4.2. For deliveries within Germany, the Seller offers the following payment options, unless provided otherwise in the relevant product description:

  • Prepayment by bank transfer/li>
  • Payment by PayPal

4.3. If prepayment has been agreed, payment is due upon conclusion of the contract.

4.4. If payment by credit card is chosen, the credit card account will be debited immediately upon acceptance by the Seller in accordance with Section 2.3 of the Seller’s General Terms and Conditions (see above).

4.5. In the event of collection by the Customer, the Seller shall initially inform the Customer by e-mail that the products ordered are available for collection. After receiving this e-mail, the Customer can collect the goods by arrangement with the Seller. In this case, no shipping costs will be charged.

5. Terms of delivery and despatch

5.1. The delivery of goods shall generally occur by mail and to the delivery address specified by the Customer. The delivery address specified in the Seller’s order is decisive for the processing of the transaction.

5.2. If the transport company returns the goods to the Seller as delivery to the Customer was not possible, the Customer shall bear the costs for the unsuccessful delivery. This does not apply if the Customer exercises its right of withdrawal by refusing acceptance, if they were not responsible for the circumstances that led to the impossibility of delivery, or if he was temporarily prevented from accepting the service offered, unless the Seller gave adequate advance notice of performance.

6. Liability for defects

The statutory liability for defects shall apply.

7. Applicable law

7.1. The law of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of the laws on the international sale of goods. In the case of consumers, this choice of law shall only apply insofar as the protection granted is not withdrawn by mandatory provisions of the law in the country in which the consumer has its customary place of residence.

7.2. The contract language is German.
